What is Escrow?
Where money and instruments are deposited with a neutral third party and delivered upon the happening of certain conditions. Such money and instruments are deemed to be "in escrow." The third party is known as the escrow agent or escrow holder.
The authority given to an escrow holder is strictly limited by instructions provided by the buyer and seller. The escrow officer is authorized by instruction to allocate funds for items during the escrow period. Instructions also specify the method of collecting funds, prorations of property taxes, homeowner associations and water companies as applicable, and the time limitations on settling the transaction. Escrow is then closed when all monies have been deposited and mutual instructions have been met.
